DUMPSTER RENTAL WAIVER - TORONTO
Thank you for choosing York1 Waste Solutions Ltd.(“YORK1”) (“the company”). We appreciate your business. By accepting or proceeding with the delivery of a dumpster, the customer named herein (“the customer”) is agreeing to the following and acknowledges they clearly understand the stated terms.
TERMS & CONDITIONS
We include professional delivery, pick up, 7 rental days & an allotment for disposal.
Payment & Price: A security deposit in the amount of the rental fee and allocated disposal cost is applicable prior to delivery, the actual cost of the dumpster will be determined upon pick up and disposal of the material. The Customer agrees that they will pay any charges including, but not limited to additional disposal costs, cancellation fees, fuel recovery, rental days, federal and provincial taxes and authorizes YORK1 to collect the balance owing from the credit card provided.
Rental Period: The rental period begins on the delivery date and ends on the scheduled pick up date. If the customer requires a rental extension, service before the scheduled pick update or requires changes to the order, please contact us. We require 24-hour notice for service. Rental Days: Homeowners: $10.00 per day after the initial 7-days; Contractors: $10.00 per day after the initial 30-days. It is solely the responsibility of the customer to schedule the removal.
Access, Placement & Loading: Customers must ensure delivery truck access and identify obstacles and hazards. Dumpster placement requires a flat, obstacle-free surface. If the customer is absent during delivery, the company will deliver based on experience. No placement on public roads, laneways, or emergency routes without permission and documentation. The company reserves the right to refuse service on dumpsters overloaded by volume or weight.
Liability: The company is not liable for any damage or injury caused to persons or property arising from the use of the dumpster during the rental period. The customer agrees to defend, indemnify, and hold the company harmless from damages, penalties, fines, and liabilities arising from excluded and prohibited waste. The Customer accepts all responsibility and hereby waives and releases all claims against the company for any damage arising from but not limited to providing dumpster rental services and the weight of YORK1 vehicles or dumpster(s) supplied (including as filled and when full). The customer is responsible for the dumpster and its contents during the rental period. Any damage or loss caused to the dumpster will result in additional charges. The customer is responsible for any damage caused to the property and surrounding area during service.
Prohibited & Excluded Waste: Including, but not limited to hazardous waste, medical waste, radioactive material, chemicals, liquids, paint, tires, pathological waste, propane tanks, and other materials that may pose a risk to human health, safety, or the environment. If the company discovers prohibited items in the waste stream during pick up, transportation, or disposal, the company may refuse to accept the waste and may charge the customer additional fees to cover the cost of proper disposal. The company is not responsible for any damages or losses resulting from the disposal or transportation of prohibited items.
Termination: The company reserves the right to terminate the agreement if the customer violates any of the terms and conditions. In such a case, the customer will immediately return the dumpster and pay any applicable charges.
Force Majeure: Should either party be prevented from fulfilling its obligations under this agreement due to circumstances beyond its control, including but not limited to natural disasters, war, pandemics, government regulations and shutdowns, or other causes beyond its reasonable control, then the affected party shall be excused from performance during the pendency of such event.
Fuel Recovery: A fuel recovery fee may apply to all products and services, including, but not limited to transportation, and disposal of materials. The fee will be determined based on the cost of fuel at the time of service and calculated as a percentage of the total cost. Mixed Waste: We only accept 100% non-hazardous solid, industrial, commercial, construction, and residential waste. If you are unsure about acceptance, please contact us. Mixed Waste Rate: $95.00 per metric tonne (1,000 kilograms). Rounded up to the nearest ten kilograms, unless otherwise specified.
Inert Fill (Concrete, Brick, Soil): Inert fill is clay brick, concrete block, concrete slab, asphalt, or soil that is smaller than a soccer ball in size and free from organic matter. This material does not chemically react with other substances and may contain other natural materials such as gravel, sand, or crushed stone. It is nontoxic, non-hazardous, and not contaminated. Inert Fill Rate: Includes the disposal cost of a full dumpster, pricing will vary by material. Absolutely NO garbage allowed. The Mixed Waste Rate applies to dumpsters containing mixed materials or other debris.
Cancellation Fee: The Company reserves the right to charge 25% on all services cancelled with less than 24 hours notice and 100% on all services cancelled after dispatching the service vehicle. Refer to Access & Placement for additional information on when the cancellation fee is applicable.
Wait Time: The Company reserves the right to charge $200.00 per hour for any additional time providing service over 15 minutes after the service vehicle arrives on site, rounded up to the next quarter of an hour.
Dump & Return: The Company reserves the right to charge a fee to cover the cost of additional transportation when required to perform a Dump & Return service. Calculated based on the time required to complete the service call, minimum $75.00.
Relocate Fee: The Company reserves the right to charge a relocate fee up to 100% of the cost of service if the customer requests a dumpster moved on site or to a different address. Should you need your dumpster moved or relocated please call us to confirm pricing.
Asbestos: This is a hazardous substance. Please contact us to arrange for special service and a dedicated dumpster. The customer agrees that they are responsible for proper sealing and loading of asbestos waste, packaged according to MOECC guidelines which are available upon request. The company reserves the right to refuse improper packaged or unsafe loads, and the Cancellation Fee will apply.
Contaminated Soil: This material requires special acceptance. Contact us to arrange for service and a dedicated dumpster. To book this service we will require specific information including bulk analytics, TCLP and qualified personal approval. Our customer service team can walk you through the process.
